This following outlines the terms and conditions for the licensing of digital designs offered by Dilly Bob Digitals, hereafter referred to as "the Seller". By purchasing and downloading any digital design from the Seller's platform (Etsy), the purchaser agrees to adhere to the terms specified herein.
Licensing Options:
Dilly Bob Digitals offers three main licensing options for digital designs:
- Personal Use License: This license is included with ALL designs and allows the purchaser to use the digital design for personal projects, gifts, or non-commercial purposes.
- Commercial Use License: This license allows the purchaser to use the digital design for commercial purposes, including but not limited to selling products featuring the design.
- Print on Demand (POD) License: This license allows the purchaser to use the digital design specifically for Print on Demand products.
Scope of Commercial Use License:
The Commercial Use License grants the purchaser the right to sell products featuring the design. This includes, but is not limited to, physical goods, merchandise, and any other products derived from or incorporating the design. Digital reselling of the design in any way is strictly prohibited.
Conditions for Commercial Use:
To exercise the rights granted under the Commercial Use License, the purchaser must adhere to the following conditions:
- The purchaser must acquire a Commercial Use License from Dilly Bob Digitals before selling ANY products featuring the purchased design.
- The Commercial Use License is non-transferable and applies only to the individual or entity named in the license agreement and only to the designated design.
- The purchaser must not claim ownership of the original digital design or redistribute the design files in any form, including but not limited to Facebook groups.
- The purchaser must not modify the digital design in a way that infringes upon the intellectual property rights of Dilly Bob Digitals or any third party.
- The Commercial Use License does not permit the purchaser to use the digital design on any Print on Demand (POD) products. A separate Print on Demand (POD) License must be obtained for such use.
Obtaining a Commercial Use or Print on Demand License:
To obtain a Commercial Use or Print on Demand License, you must purchase the appropriate listing based on which license you need, both can be found under the Licenses Section of our shop. Upon completion of the purchase and payment, the purchaser’s receipt from Etsy will serve as confirmation of their Commercial Use or Print on Demand License.
Enforcement:
Dilly Bob Digitals reserves the right to enforce the terms of this policy through legal means, including but not limited to pursuing damages for copyright infringement. Failure to comply with the terms outlined in this policy may result in the revocation of the purchaser's license and legal action.
Amendments:
Dilly Bob Digitals reserves the right to amend or update this policy at any time without prior notice. Any changes will be effective immediately and will be posted for one week on the Shop Announcements of Dilly Bob Digitals Etsy Shop.
